CPSC Issues Notice of Proposed Rulemaking for Toys Containing Button Cell or Coin Batteries
On 10 Jul 2024, CPSC issued a briefing package: Requirements for Toys Containing Button Cell or Coin Batteries. CPSC staff recommends that the Commission publish the draft notice of proposed rulemaking (NPR), which would establish a new mandatory standard for toys containing button cell and coin cell batteries, to provide the highest level of safety for such toys that is feasible.
The Commission voted unanimously (5-0) to approve the publication of the notice on Requirements for Toys Containing Button Cell or Coin Batteries in the Federal Register, as drafted. The NPR proposes to add test requirements for captive fasteners, minimum requirements for threaded fasteners, and sequential use and abuse testing (stress relief, battery replacement, impact, crush, torque, tension, compression, and compliance verification tests), and to update marking and labeling requirements. The additional requirements are more stringent than the existing requirements in part 1250, ASTM F963-23, and UL 4200A-23 to further reduce the risk of injury from these batteries and represent the highest level of safety feasible to address child ingestion of button cell or coin cell batteries from toys.
Draft NPR is published on Aug 13, 2024 in the federal register. The public can provide comments within 60 days until 15 Oct, 2024.
Expected Effective date: 180 days after publication and approval of the final rule.
